1. Introduction and Acceptance of Terms

Welcome to Auto China Global (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the website AutoChina.Global (the “Site”) and the purchase of vehicles and related services provided by Auto China Global.
 
By accessing this Site, requesting a quotation, or placing an order for vehicles, you (“Client,” “Buyer,” or “you”) agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.
 
These Terms apply to all clients, including car dealers, distributors, fleet buyers, government entities, and individual importers.

3. Eligibility

3.1 Business Clients: Our primary business model is B2B. Dealers, distributors, and fleet buyers must provide valid business registration documents to establish an account. 3.2 Individual Importers: Individual buyers are responsible for verifying their legal eligibility to import vehicles into their destination country. 3.3 Age Requirement: You must be at least 18 years old or the legal age of majority in your jurisdiction to enter into a contract with Auto China Global.
 

4. Products and Pricing

4.1 Vehicle Descriptions: We strive to provide accurate descriptions, specifications, and images of vehicles (including Electric Vehicles, Hybrids, Gasoline Cars, SUVs, Sedans, Pickups, and Commercial Vehicles). However, specifications may change due to manufacturer updates without prior notice. 4.2 Pricing: All prices are quoted in [USD/CNY/EUR] unless otherwise specified. Prices are subject to change without notice until a Proforma Invoice is issued and accepted. 4.3 Factory-Level Pricing: Our pricing reflects wholesale/export rates. Prices do not include import duties, taxes, registration fees, or local compliance costs in the Buyer’s destination country unless explicitly stated in the contract (e.g., DDP Incoterm). 4.4 Currency Exchange: Payments made in currencies other than the quoted currency are subject to exchange rate fluctuations. The Buyer bears any risk associated with currency conversion.
 

5. Orders and Acceptance

5.1 Quotation: A quotation is an invitation to treat and is valid for [Insert Number, e.g., 7] days from the date of issue. 5.2 Order Confirmation: An order is only accepted upon receipt of a signed Sales Contract and the required deposit payment. Auto China Global reserves the right to refuse any order for any reason, including lack of stock or compliance concerns. 5.3 Stock Availability: While we maintain a large network, vehicle availability is subject to manufacturer stock. If a vehicle becomes unavailable, we will offer a comparable alternative or a full refund of the deposit.
 

6. Payment Terms

6.1 Methods: We accept payments via Bank Transfer (T/T), Letter of Credit (L/C), or other mutually agreed secure international payment methods. 6.2 Deposit: A non-refundable deposit of [Insert Percentage, e.g., 30%] is required to confirm the order. 6.3 Balance Payment: The remaining balance must be paid before the Bill of Lading is released, unless otherwise agreed under a Letter of Credit. 6.4 Fraud Prevention: We reserve the right to verify the source of funds. 7. Shipping, Delivery, and Incoterms

7.1 Incoterms: All shipments are governed by the latest Incoterms® rules (e.g., FOB, CIF, CFR, EXW, DDP). The specific Incoterm for each transaction will be clearly stated in the Sales Contract. 7.2 Risk of Loss: Risk of loss or damage to the vehicles passes from Auto China Global to the Buyer according to the agreed Incoterm. 7.3 Delivery Times: Estimated delivery times are provided for guidance only. Auto China Global is not liable for delays caused by shipping lines, port congestion, customs clearance, weather, or force majeure events. 7.4 Shipping Costs: Unless agreed otherwise, the Buyer is responsible for all shipping, insurance, and freight costs. 7.5 EV Battery Shipping: Special regulations apply to the shipping of Electric Vehicles due to battery classification. We handle necessary documentation, but delays due to hazardous cargo regulations are beyond our control.
 

8. Inspection and Acceptance

8.1 Pre-Shipment Inspection (PSI): We offer pre-shipment inspection services. Buyers are encouraged to inspect vehicles or hire a third-party inspector before shipment. 8.2 Claims: Any visible damage or discrepancies must be reported immediately upon receipt of the vehicle at the destination port. Claims must be supported by photographic evidence and official port reports. 8.3 Acceptance: Once the vehicle leaves the port of origin, acceptance is deemed final regarding cosmetic condition unless insurance claims are filed for transit damage.
 

9. Warranty and After-Sales Support

9.1 Manufacturer Warranty: Vehicles are sold with the standard manufacturer’s warranty valid in the region of origin. International warranty validity depends on the specific brand’s global policy. 9.2 Exporter Liability: Auto China Global acts as an exporter. We are not the manufacturer. We will assist in facilitating warranty claims with the manufacturer, but we do not guarantee free repair services in the Buyer’s local market unless a specific service agreement is in place. 9.3 Exclusions: Warranty does not cover damage caused by accidents, misuse, neglect, unauthorized modifications, or failure to comply with maintenance schedules. 9.4 Parts Supply: We can facilitate the export of spare parts, but availability is subject to manufacturer stock.
 

10. Import Compliance and Regulations

10.1 Buyer Responsibility: The Buyer is solely responsible for ensuring that the vehicles comply with the laws, regulations, safety standards, and emission standards of the destination country (e.g., homologation, steering wheel position, speedometer units). 10.2 Customs and Duties: The Buyer is responsible for all import duties, taxes, VAT, customs clearance fees, and registration costs in the destination country. 10.3 Prohibited Markets: We do not export to countries under international sanctions or embargoes.
 

11. Limitation of Liability

11.1 Consequential Damages: Auto China Global shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profit, business interruption, or loss of data. 11.2 Liability Cap: Our total liability for any claim arising out of these Terms or the sale of vehicles shall not exceed the total purchase price of the vehicle(s) involved in the claim. 11.3 Force Majeure: We are not liable for failures or delays caused by events beyond our reasonable control, including but not limited to acts of God, war, strikes, pandemics, government actions, or supply chain disruptions.
 

12. Intellectual Property

12.1 Ownership: All content on this Site, including logos, text, images, and vehicle data, is the property of Auto China Global or our partners and is protected by copyright and trademark laws. 12.2 Usage: You may not use our intellectual property for commercial purposes without written consent.
 

13. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data. By using our services, you consent to the practices described in the Privacy Policy.
 

14. Modifications to Terms
